According to O'Neil, she experienced gagging, nausea, and a burning sensation in her mouth after the incident and went to urgent care. The lawsuit alleges she thought the glove tip might have contained the end of a human finger, which she may have inadvertently swallowed. O'Neil has a history of similar legal actions: she previously sued Starbucks in 2020 for a similar amount after falling in a puddle and injuring her knee, but dropped that lawsuit in 2021.
In 2024, she sued a massage therapist for $710,000 plus medical bills and lost wages, but dropped that claim in May 2025. 4 million class-action lawsuit for violating the Fair and Accurate Credit Transaction Act. Brian Keim sued the company in 2020 for exposing too many digits of his credit card number on a receipt, leading to the settlement.

It is unknown whether Trader Joe's has responded to O'Neil's lawsuit, if any evidence supports her claims, or the current status of the case.
