The Crown Prosecution Service (CPS) declined a request by Andrew and Tristan Tate for written assurances that they would not be arrested if they returned to the UK for the civil proceedings, according to major media reports. The Tates are now seeking a stay in the civil case, arguing it could seriously prejudice their criminal defence. Their barrister, Vanessa Marshall KC, stated: "If the defendant is prosecuted, the claimants will have their 'day in court'. If the defendant is convicted, they will see him punished…On the other hand, if the defendant is not prosecuted, or is acquitted after trial, the integrity of the civil proceedings will have been preserved – the parties can then apply to the court to lift the stay and restore proceedings."

The CPS has charged the Tates with 21 criminal charges in a separate case, including rape, actual bodily harm and human trafficking. Andrew Tate faces 10 charges including rape, actual bodily harm, human trafficking and controlling prostitution for gain. The brothers have denied all wrongdoing in the criminal case. Andrew Tate is also bringing a legal challenge against the CPS, with the first High Court hearing due on June 23.

It appears extremely unlikely, given the defendant’s public statements, that he will ever voluntarily return to the UK, a view further supported by the fact that he and his brother have made a formal application to give evidence remotely in these proceedings from America.

In the civil case, four women accuse the Tate brothers of rape, coercive control, and assault and battery. The trial was due to begin in June but has been adjourned by Judge Mrs Justice Lambert. Anne Studd KC, barrister for the four women, said: "When you get given a trial date you work your way to the trial date and for it to be adjourned this late in the day is at least very unfortunate indeed." The judge said there would be a regrouping in July and potentially a more substantive hearing before Christmas. More than half a million chat and SMS records, more than half a million photos, thousands of video and audio files and other messages and emails are in police possession.

Hertfordshire Constabulary reopened an investigation into sexual abuse allegations against Andrew Tate made in 2014 and 2015. The reinvestigation will be run by the Major Crime Unit of Bedfordshire, Cambridgeshire and Hertfordshire Police, involving ten devices seized during the original investigation. The reinvestigation of criminal allegations made in 2015 by three women will not be limited to current evidence and could lead to new witnesses and alleged victims. The specific evidence that led to the reopening in March 2025 has not been disclosed.
