The Gothenburg Administrative Court of Appeal (Kammarrätten i Göteborg) has imposed substantial fines on nine Swedish regions for procurement violations related to the Cosmic journal system. According to reports, each region must pay 10 million kronor in procurement damage fees, totaling 90 million kronor.
The court found that the regions violated procurement laws when they entered into supplementary agreements for the Cosmic electronic health record system without conducting a new procurement process. The Swedish Competition Authority (Konkurrensverket) had argued that the supplementary agreements were so extensive that they should have triggered a new procurement, a position the court agreed with.
The investigation began in summer 2023 after the Competition Authority received a tip about several Sussa-regions' amendment agreements. Region Dalarna was specifically mentioned among the eight other regions facing the fines. The court's decision represents a significant enforcement action against public procurement violations in Sweden's healthcare sector.
