Bar staff called the police following a misunderstanding, according to Rory's parents. Rory spent two days in a concrete jail cell, his parents said. He was released on bail but his passport was confiscated, preventing him from leaving Thailand, according to his parents.
For the last seven weeks, Rory has been living out of a hotel in Pattaya, according to multiple reports. Rory paid police £1,000 in bail money, according to Rory.
Then he was cuffed and taken to the cells. He was there for two nights - he told us it was horrendous. He was on a concrete floor and all he had for a pillow was a plastic water bottle.
Helen McColl, Rory's mother, described how he was handcuffed and taken to the cells, where he spent two nights on a concrete floor with only a plastic water bottle for a pillow. She also said that a man approached Rory in his cell claiming to be a lawyer who would represent him. Rory paid the man twice, but his family were suspicious, according to his parents. John McColl, Rory's father, described it as incredible that Rory could go to jail on a charge where the injured party says she knows it is a misunderstanding and does not want to press charges.
The woman whose phone was taken appears to corroborate Rory's story in an email exchange seen by the BBC. However, the authenticity of the email exchange could not be verified by the BBC.
Rory told us this man stood by him in court and told him he would help to get him back to his son but that never happened. The one time he told him to come to court, he sent him away again and told him: 'It is not a good judge today, this one will send you to prison.' Alarm bells started to ring when the guy asked Rory to travel two hours to court then sent him away again and when no action had been taken at all.
Several unknowns remain: the exact charge against Rory has not been confirmed; it is unclear whether the woman will press charges or drop the case; the status of the preliminary court hearing is unknown; and it is uncertain whether the lawyer who approached Rory is legitimate or a scammer. The fate of Rory's passport and his ability to leave Thailand also remain unclear.
It is just the unknown that is scary. We don't know for certain what will happen now and that is what keeps us up at night.
