Prosecuting fiscal Jack Muir stated, "The accused's vehicle came towards her on the wrong side of the road. " The impact caused Tinney's car to flip onto its roof, and both vehicles were extensively damaged. The female driver suffered a fracture to her knee as well as bruising and whiplash.

Police breathalysed Tinney, who was bleeding from a head wound, and he gave a positive reading for alcohol. He was arrested and taken to hospital for treatment. Tinney admitted causing serious injury to the woman by driving dangerously while under the influence of alcohol.

At Hamilton Sheriff Court, Sheriff Louise Gallacher banned Tinney from driving for two years and required him to resit his test if he wants to drive again. Defence agent Desmond Ziolo referred to Tinney's "previous good character" and the fact he is in full-time employment, adding, "It's a very serious offence and he accepts it's aggravated by being under the influence of alcohol.

" Sheriff Gallacher accepted Tinney had shown "extreme remorse" and told him, "I'm satisfied there is an alternative to a custodial sentence available. " The exact blood alcohol concentration level of Scott Tinney at the time of the crash has not been disclosed. The full name and current condition of the female driver who was injured remain unknown.
