According to Rémi Gaillard, his profession de foi was invalidated following a report from the Socialist Party list of Michaël Delafosse. He stated that if the decision stands, he would be the only candidate whose profession de foi will not be distributed in Montpellier. Gaillard directly accused the campaign director of outgoing mayor Sébastien Cote of making the report.

He said other lists called him to say two lists, including the PS list represented by Cote, made a report. Gaillard did not have a representative at the commission, which all other lists attended. An independent magistrate reviewed the case and concluded the profession de foi was invalid.

Gaillard claimed the reason was colorimetric, with blue, beige, and red colors causing confusion with the tricolor flag. In contrast, Sébastien Cote indicated that several lists pointed out Gaillard represented himself with blue, white, and red on the back, which he stated is prohibited by the electoral code. Article R27 of the code bans such use when it may confuse with the national emblem.

Gaillard plans to appeal with his lawyer Jean-Robert Nguyen-Phung. His ballots are compliant with the electoral code. It is unknown how many other lists reported the issue or if the appeal will succeed.
