Norway courts give varied sentences in cannabis cases
Key Points
  • Sandefjord case: two men received community sentences for cannabis cultivation.
  • Osterøy case: farm owner got suspended sentence; Lithuanian father and son convicted of organized crime.
  • Courts considered cooperation and lifestyle changes in sentencing.

In Sandefjord, a 31-year-old man was stopped by police in November 2024 and tested positive for drugs, leading to a search of his property where officers found a professionally rigged cannabis plantation with tents, ventilation, lights, and over 700 grams of dried plant material. Two other men were arrested, but charges against one were dropped just before trial due to doubts about his criminal accountability. The court found it proven that the 31-year-old and a 33-year-old attempted to cultivate 53 large plants with a production potential of at least 1.5 kg of cannabis, with the plan to become self-sufficient. A third man testified that he took 90 cuttings from the existing plants without the others' knowledge, and the court believed his explanation, which influenced the sentence. Vestfold District Court emphasized that the men came clean in their first interrogations and have shown very positive development in changing their lifestyle, leading to community sentences despite the typical starting point of unconditional imprisonment for such amounts.

On Osterøy, a Norwegian woman in her 40s and two Lithuanian men were convicted after a large cannabis plantation was found on the woman's farm in November 2024. The woman, who rented out the farm, was convicted of negligent handling of stolen goods amounting to 417,000 kroner. She claims she was unaware and naive about what was happening and does not admit guilt. She was sentenced to 60 days suspended imprisonment with probation. The two men, a father and son from Lithuania, both admitted to being behind the cannabis cultivation. The father was sentenced to four years and nine months in prison, while the son denied participating in the plantation on Osterøy but admitted cannabis cultivation at an address in Blomsterdalen. Both men were convicted of organized crime.
