A man in his 40s previously convicted of raping a 100-year-old woman has been acquitted by Svea Court of Appeal. The court stated the evidence was insufficient. The man, a former home care employee, was convicted in December and sentenced to four years in prison for raping the woman he was assigned to care for.
He was also charged with raping a 94-year-old woman, but the district court found it could not be established that he was guilty in that case. The conviction was appealed, and Svea Court of Appeal has now reviewed the case, concluding the evidence was not sufficient in the case involving the 100-year-old woman. According to the court, the central evidence consists of recorded interrogations with the two women, and the court noted that it was clear the women and the interrogator often had difficulty understanding each other.
Information also changed during the interrogations. Svea Court of Appeal stated it was not beyond reasonable doubt that the man committed the crimes, which is required for a conviction.
